Agreement to Terms

Welcome to IELTS Flashcards (the “App”). IELTS Flashcards is a flashcard mobile application designed to help you learn English words through interactive flashcards. These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and the App developer (“we,” “us,” or “our”) regarding your use of the IELTS Flashcards mobile application and related services.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

Disclaimer

Important Notice:

IELTS Flashcards is an independent mobile application developed by an independent developer. This App is not associated with, endorsed by, or affiliated with IELTS (International English Language Testing System) or any of its organizations, including but not limited to the British Council, IDP Education, Cambridge Assessment English, or any other official IELTS testing bodies. The use of “IELTS” in the app name is for descriptive purposes only to indicate that the app may be useful for IELTS test preparation, but it does not imply any official connection or endorsement.

Description of Service

IELTS Flashcards is a flashcard mobile application designed to help users learn English words through:

  • Interactive flashcards for learning English words organized by language levels (A1, A2, B1, B2, C1, C2) and categories
  • English word lists and flashcard tests
  • Progress tracking and statistics for your English word learning
  • Audio pronunciation features for English words
  • Flashcard-based learning system to master English vocabulary

The App offers both free and premium (“Pro”) features. Pro features may include additional English word content, advanced flashcard features, or ad-free experience.

Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have agreed to these Terms on your behalf.

By using the App, you represent and warrant that:

  • You are at least 13 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • You will not use the App for any illegal or unauthorized purpose

Account and Registration

The App does not require you to create an account to use basic features. However, certain features, including Pro subscriptions, may require authentication through your device's App Store account (Apple ID or Google Account).

Subscription and Payment Terms

Pro Subscription

IELTS Flashcards offers Pro subscription plans that provide access to premium features, including additional English word content, advanced flashcard features, and an ad-free experience:

  • Monthly Pro: 1 month – Product ID: ielts_flashcards_monthly_pro
  • Annual Pro: 1 year – Product ID: ielts_flashcards_annual_pro
  • Lifetime Pro: One-time purchase – Product ID: ielts_flashcards_lifetime_pro

Subscription prices are shown in-app and may vary based on your location and currency.

Payment and Auto-Renewal

  • Payment: Subscriptions are processed through Apple App Store (iOS) or Google Play Store (Android). Payment will be charged to your App Store account at confirmation of purchase.
  • Auto-Renewal: Monthly and Annual subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. Note: Lifetime Pro is a one-time purchase and does not auto-renew.
  • Cancellation: You can cancel your subscription at any time through your device's App Store settings:
    • iOS: Settings > [Your Name] > Subscriptions
    • Android: Google Play Store > Subscriptions
  • Refunds: Refund requests are subject to the policies of Apple App Store or Google Play Store. We do not provide direct refunds.
  • Price Changes: We reserve the right to change subscription prices. Price changes will be communicated to you in advance, and you will have the opportunity to cancel your subscription before the new price takes effect.

Free Trial

If offered, free trials will be clearly indicated. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless cancelled before the trial ends.

User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App to transmit any malicious code, viruses, or harmful software
  • Not interfere with or disrupt the App's functionality
  • Not use automated systems (bots, scrapers) to access the App
  • Not share your subscription with others or allow unauthorized access
  • Respect intellectual property rights
  • Provide accurate information when making purchases

Intellectual Property Rights

Our Rights

The App, including its original content, features, functionality, design, logos, and trademarks, is owned by us and protected by international copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or create derivative works of the App
  • Remove any copyright, trademark, or other proprietary notices
  • Use our trademarks or logos without prior written permission
  • Reproduce, distribute, or publicly display the App's content without authorization

User Content

Any content you create or generate within the App (such as English word learning progress data and flashcard test results) remains your property. However, by using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely for the purpose of providing the App's flashcard learning services.

Disclaimers

Educational Content

The App is provided for educational purposes to help you learn English words through flashcards. While we strive to provide accurate and up-to-date English word content, we do not guarantee:

  • The accuracy, completeness, or reliability of any English word content or definitions
  • That the App will meet your specific English word learning goals
  • That the App will be error-free or uninterrupted
  • That any results or outcomes from using the flashcard learning system

No Warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be available at all times
  • The App will be free from errors, bugs, or defects
  • The App will be secure or free from viruses
  • The App will meet your requirements

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or English word learning progress
  • Loss of profits or revenue
  • Business interruption
  • Personal injury or property damage
  • Any damages resulting from your use or inability to use the flashcard learning App

Our total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

Termination

By You

You may stop using the App at any time by:

  • Uninstalling the App from your device
  • Cancelling your subscription (if applicable)

By Us

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Discontinuation of the App or service

Upon termination:

  • Your right to use the App will cease immediately
  • We may delete your locally stored data
  • You will not be entitled to any refund (except as required by law)

Data and Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Third-Party Services

The App may integrate with or link to third-party services, including:

  • RevenueCat: For subscription management
  • Apple App Store / Google Play Store: For app distribution and payments
  • Audio Services: For pronunciation features

We are not responsible for the privacy practices, content, or services of third parties. Your interactions with third-party services are subject to their respective terms and privacy policies.

Updates and Modifications

App Updates

We may update the App from time to time to:

  • Add new features or content
  • Fix bugs or improve performance
  • Update security measures
  • Comply with legal requirements

You may need to update the App to continue using it. Updates may be automatic or require manual installation.

Terms Updates

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the “Last Updated” date
  • Providing in-app notifications (for significant changes)

Your continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the App developer operates, without regard to its conflict of law provisions.

Dispute Resolution Process

If you have a dispute with us, you agree to:

  1. First contact us directly to attempt to resolve the dispute
  2. If unresolved, engage in good faith negotiations
  3. If still unresolved, disputes may be resolved through binding arbitration or in courts of competent jurisdiction, as applicable

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms or any rights hereunder without restriction.
