Color Picker: Capture colours with your camera - Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Color Picker mobile application (the "App"). By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Who We Are

The App is provided by Melih Firat ("we," "us," or "our").

2. Age and Eligibility

The App has no age restrictions. If you are under the age of majority in your jurisdiction, you should use the App under the supervision of a parent or legal guardian.

3. Subscriptions and Billing

The App offers an optional subscription group called "Pro" ("Subscription"):

Annual Pro: 1-year term, product id annual_pro
Monthly Pro: 1-month term, product id monthly_pro

Billing and payment are processed by the applicable app store (e.g., Apple App Store, Google Play). You must maintain a valid payment method with the store.

Auto-Renewal: Subscriptions automatically renew for the same term and price unless canceled at least 24 hours before the end of the current period.

Manage or Cancel: You can manage or cancel your Subscription in your device's account settings for the app store.

Refunds: Refunds, if any, are handled by the app store under its policies. We do not issue direct refunds.

Price and Changes: We may change Subscription pricing or features prospectively. Any change will apply on your next billing cycle, and you will be notified as required. If you do not agree, cancel before renewal.

4. License and Acceptable Use

We grant you a limited, personal, non-transferable, non-exclusive license to use the App for its intended purpose.

You agree not to:

Reverse engineer, decompile, or attempt to access source code, except as permitted by law.
Use the App in any unlawful, harmful, or infringing manner.
Interfere with or disrupt App operation or security.
Circumvent any access control or usage limits.

5. User Content and Camera Use

The App may use your device camera to detect colors as part of the App's features. You are responsible for how you use the camera and any content you capture. Do not capture or share content that violates others' rights or applicable laws.

6. In-App Advertising and Third Parties

The App may display ads and may integrate third-party services (e.g., analytics, purchase providers). Your use of third-party services is subject to their terms and policies.

7. Intellectual Property

The App, including all content, features, and functionality, is owned by us or our licensors and is protected by intellectual property laws. No rights are granted except as expressly stated.

8. Disclaimers

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free, or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising from your use of the App. Our total liability for any claims relating to the App will not exceed the amounts you paid (if any) for the Subscription during the twelve (12) months prior to the claim.

10. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Termination does not entitle you to any refund unless required by the app store's policy or applicable law.

11. Changes to the App and Terms

We may modify or discontinue features at any time. We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms.

12. Governing Law; Dispute Resolution

These Terms are governed by the laws of [Insert governing jurisdiction], without regard to conflict of law rules. Any disputes will be resolved in the courts of [Insert venue], unless applicable law requires otherwise.

13. Severability; Entire Agreement
